Immigration and Asylum Options

Immigration & Asylum

If your goal is to stay in the United States permanently, you need an immigrant visa. At the Burchinow Immigration Law Firm in Denver, Colorado, we have helped many clients secure a variety of immigrant visas.

Working with a country’s consulate can present various challenges. That is why you need the type of representation we provide. We get through the red tape and secure the immigrant visa for qualified employees and family members.

Immigrant Visas for Family Members

Visas for family members are popular immigrant visas. However, not all relationships qualify for permanent residency. There are immediate relative and preference immigrant categories. Immediate relatives who qualify include:

  • Minor children who are unmarried and under 21 years old
  • Parents if the US citizen is at least 21.
  • Unmarried sons and daughters, married children, spouses and siblings

While certain conditions may apply, we can help your family members secure an immigration visa.

Spouse or Fiancé Immigration Visa

Learn more about spousal immigration visas on our marriage visa and fiance visa services page.

Employee Immigrant Visas for Employees

An employment immigration visa is based on business needs, relationships, or investments. There are five qualifying categories for employee immigrant visas, with priority given to people with advanced degrees and skills, as well as special categories for foreign citizens who served the interests of the US military and their immediate family, foreign citizens with medical skills, and even investors.

With so many different categories and priorities given, it’s a good idea to contact an immigration attorney to discuss your employee immigrant visa application. In many cases, you do not need an employer to apply for this type of visa. Depending on your skills or background, you may be able to obtain an employee visa.

Reports and Examinations in Asylum Cases

At our firm, we review human rights reports and other information from the US State Department, Amnesty International and other organizations on your behalf. However, many times, better evidence of possible persecution and harm can be found. We work with physicians and therapists who will examine any scars or other injuries – such as Post-Traumatic Stress Disorder – that you may have suffered in your home country as a result of your persecution. We can then attach the doctor’s findings to your asylum application filed with the US Citizenship and Immigration Services or, if you are in removal proceedings, we submit it to the Immigration Court as evidence of persecution. Often times, asylum is granted.
