Immigrant Visas for Family Members
Visas for family members are popular immigrant visas. However, not all relationships qualify for permanent residency. There are immediate relative and preference immigrant categories.
Immediate relatives who qualify include minor children who are unmarried and under 21 years old. That category also includes parents if the US citizen is at least 21. Preference immigrants include unmarried sons and daughters, married children, spouses and siblings. Certain conditions apply if the applicant or children are over or under the age of 21.
Immigrant Visas for Employees and Spouses
At the Burchinow Immigration Law Firm, we help clients secure permanent residency through employment-based immigration and family-based immigration. An employment immigration visa is based on business needs, relationships, or investments. Family-based immigration is based on the “Immediate Relative” relationship between an alien and a qualified relative. An Immediate Relative includes the spouse and minor children of a US citizen; it may also include parents if the US citizen is at least 21 years old. They do not have a waiting period because their visas are immediately available; however the processing time between the filing of a Petition for Immediate Relative together with an Application to Adjust Status is about 6 months. Consulates will provide visas for spouses following proof of a lawful marriage, affidavit of support by the US citizen and possibly a co-sponsor, medical exam by a certified physician, background check and other supporting documentation.
